Group and Events Booking Terms and Conditions – HAKKASAN FESTIVE

The terms and conditions set out below apply to the Customer’s booking and form part of the contract between the customer and HAKKASAN as part of Hakkasan Limited (“the Restaurant”). The Customer’s booking will be confirmed upon receipt of the completed and signed booking form and/or deposit (if required) from the Customer.

1 Deposit
The Restaurant reserves the right to require the payment of a non-refundable deposit to the sum set out in the booking form. The booking will only be confirmed upon receipt of the Customer’s deposit. Where a deposit is required, it is only refundable if a meal or event is cancelled a minimum of 72 hours in advance of the booking.

2 Minimum spend
If the booking form includes a minimum spend, then that is the absolute minimum you must pay to the Restaurant for the meal or event. If at the end of the meal or event, the sum actually spent by you is less than the minimum spend specified in the booking form then, unless you have already prepaid the minimum spend amount in full, the Restaurant will add a hire charge to the sum spent in order to bring it up to the minimum spend.

Conversely, if at the end of the event, the sum actually spent exceeds the minimum spend, then you shall be required to pay the excess amount (less any deposit previously paid.)

3 Additional payments
Any additional expenditure incurred by the Restaurant in connection with your specifications for the event or meal (as set out in the booking form) shall be charged separately by the Restaurant and settled by you no later than 7 days prior to the event.

4 Late and non-payment
If you fail to make any payment as set out above, the Restaurant may, without any liability to you, cancel the booking and charge you for any costs incurred by it in connection with the event.

5 Cancellation
Where no deposit is required on the booking form, a cancellation fee of £40 per person will be payable by the Customer to the Restaurant, unless the Customer has cancelled the meal or event in writing, a minimum of 72 hours before the arrival time in the booking form. All cancellations are required in writing and receive confirmation of receipt of cancellation from the restaurant in writing to be valid. By filling in the form and signing you are accepting the terms and conditions detailed herewith.

6 Credit Card
A credit card is required to secure the booking, and the Restaurant reserves the right to charge the card if you fail to make any payment in accordance with the terms set out above

7 Service charge
A discretionary service charge of 13.5% of the total value of all food and drink consumed will be included in the final bill. Where a minimum spend is applied to the booking the discretionary service charge at 13.5% will be in addition to the final bill.

All food and drink charges are inclusive of VAT.

9 Allergies and intolerances
Guests with allergies and intolerances should make a member of the team aware, before placing an order for food or beverages. Guests with severe allergies or intolerances, should be aware that although all due care is taken, there is a risk of allergen ingredients still being present. Please note, any bespoke orders requested cannot be guaranteed as entirely allergen free and will be consumed at the guest’s own risk.

10 Number of guests in booking
The Restaurant reserves the right to refuse entry to guests if the number of guests exceeds the numbers stated in the booking form. The Customer is also liable to pay for the number or pre-ordered menus, unless a minimum of 72 hours’ notice before the arrival time in the booking form is given in writing for changes to the numbers of guests.

11 Guest’s conduct
The Restaurant reserves the right, in its absolute discretion, to refuse entry to or eject guests if at any time, in the view of the Restaurant, their behaviour is unsuitable. You shall be responsible for any damage, theft or loss to the Restaurant, its furnishings, furniture, fixtures, fittings and equipment caused by your, your guests’ or any other person on the premises (other than the Restaurant’s employees or contractors) by reason of the meal or event wilful, negligent or accidental actions. You shall pay the Restaurant immediately on demand, the amount required to make good or replace such damage, stolen or lost property.

12 Dress code
The Restaurant’s dress code is smart and trainers, caps or vests are not to be worn on the premises at any time. The Restaurant reserves the right, in its absolute discretion, to refuse entry to you or any of your guests should you or they be inappropriately dressed.

13 Your property
The Restaurant is not liable for you or your guests’ property such property is lost or damaged whilst on the premises.

14 Force majeure
The Restaurant will have no liability nor be required to pay any compensation where it is not possible for the event or meal to go ahead as a result of a force majeure or any circumstance beyond its reasonable control. These events include (but are not limited to) flood, earthquake, extreme adverse weather conditions, natural disasters, acts of terrorism, fire and failure of water, electricity, gas or other utility service. Where it has not been possible for the booking to go ahead due to an event of force majeure or any other circumstance beyond its reasonable control, the Restaurant shall reimburse you any amounts pre-paid in relation to the event or meal.

15 Cancellation by the Restaurant
The Restaurant reserves the right to cancel any booking if the Restaurant is to be closed on the date of the event or meal due to repair or refurbishment. In such case it will give you no less than [30] days’ notice and any deposit or other pre-paid amount in connection with your booking will be reimbursed to you.

16 Restaurant and Hakkasan logos and intellectual property
You shall not use the Restaurant’ or any Hakkasan logo or other intellectual property rights without the Restaurant’s prior written consent. Where consent is given by the Restaurant your right to use any logo or intellectual property rights shall be limited to the event or meal and any promotional materials you may create in connection with it will have to be first approved by the Restaurant. Any unapproved materials using any logos or intellectual property rights of the Restaurant or Hakkasan must be immediately destroyed.

17 Confidentiality
Each party agrees and undertakes that it will keep confidential, will not use for its own purposes and will not without the prior written consent of the other party disclose to any third party, any information of a confidential nature (which, for the avoidance of doubt, shall include the terms of this contract and the chosen menu) belonging or relating to the other party which is disclosed to it by
